Allen & Overy and Rymarz Zdort have advised the sponsor and shareholder of Polcom Modular on concluding a partial scheme of arrangement with a consortium of lenders through Polish-law court restructuring proceedings. Linklaters advised the lenders.

According to Allen & Overy, "in the third quarter of 2021, the partial arrangement was sanctioned by the Polish court. The scheme covered a compromise between the company and its financial creditors."

Polcom Modular is a Polish construction company, providing modular building systems and interiors for hotel brands. The company operates three manufacturing facilities in Poland, and the produced modules are being used for low-rise and high-rise buildings in Europe, on the East and West Coast of the United States, in the Caribbean, and in Canada.

The Allen & Overy team was led by Warsaw-based Partner Bartosz Merczynski and London-based Partner Kathleen Wong and included Warsaw-based Counsel Maciej Kulawik, Senior Associate Pawel Bartosiewicz, Associates Ewa Tkaczuk and Maciej Wisniewski, and London-based Associate Chong-Aik Lee.

The Rymarz Zdort team was led by Partner Magdalena Pyzik-Walag and included Partner Leszek Tokarski, Counsel Jakub Rachwol, Senior Associate Krzysztof Rembierz, and Associates Jakub Cichuta and Sebastian Mikina.
